“Nine Students Indicted after Bullied Student Commits Suicide”
In Massachusetts, Northwestern District Attorney Elizabeth
Scheibel, who outlined the charges, also faulted officials at South Hadley High School.
Scheibel’s investigation determined the girl’s harassment had been
“common knowledge,’’ contradicting administrators’ previous assertions
that they had been unaware of problems until after her death.
Questions for School Administrators –
Are school administrators facing civil liability? Yes
Can liability be avoided? Yes
The tragic outcome of bullying at this small school in western
Massachusetts
has resulted in criminal prosecutions, the likelihood of civil
litigation, and the enactment of anti-bullying legislation by the Massachusetts legislature.
It appears that the school administrators ignored what was happening –
but there were steps that could have been taken to minimize the impact
of the bullying. If knowledge could have been proved, there was a duty
to act.
THERE ARE STEPS THAT COULD HAVE BEEN TAKEN!
In a 45 minute DVD – Henry M. Quinlan, Esq., founding editor of the
School Law Bulletin and Publisher of Omni Publishing Co., reviews the
current law on the duty to act for school administrators and teachers
and recommends courses of action for school administrators and teachers
when they become aware of a bullying situation.
